Terms of Service

These Terms of Service ("Terms") govern your access to and use of the PayKato website, dashboard, APIs and related services (the "Service"), operated by Omega Allied Services LTD ("PayKato", "we", "us"). By creating an account or using the Service, you agree to these Terms.
1. Eligibility & account
You must be at least 18 years old, legally able to enter into contracts, and not barred from using financial services under applicable law or sanctions lists. You are responsible for the accuracy of the information you provide and for keeping your credentials secure.
2. The Service
PayKato is a software platform that helps merchants accept payments and request payouts through licensed payment processors and banking partners. PayKato is not a bank, is not a money transmitter, and does not hold customer funds. Funds movement is performed by our partners under their own terms and licenses.
3. Partner terms
Use of payment, payout, KYC, and currency-conversion features may require you to accept the terms of our partners (for example, Stripe, Paystack, Flutterwave, Didit, or local banks). Where partner terms conflict with these Terms for partner-provided functionality, the partner's terms govern that functionality.
4. Fees
PayKato platform fee from 1.5%. Processor, FX, payout, bank, and country-specific fees may apply and are disclosed separately. Fees may change with notice.
5. Prohibited use
You agree not to use the Service for businesses or activities listed in our Prohibited Businesses page or in violation of our Acceptable Use Policy.
6. Suspension & termination
We may suspend or terminate access at any time if we reasonably believe an account violates these Terms, partner rules, or applicable law, or if continued service would expose PayKato, partners, or end users to undue risk.
7. Disclaimers
The Service is provided "as is" without warranties of any kind. We do not warrant uninterrupted operation, error-free results, or specific settlement timing.
8. Limitation of liability
To the maximum extent permitted by law, PayKato is not liable for indirect, incidental, consequential, or punitive damages, or lost profits, revenue, or data. Our aggregate liability for any claim is limited to the platform fees you paid PayKato in the three months preceding the claim.
9. Indemnity
You agree to indemnify PayKato and our partners against claims arising from your use of the Service, your products or services, or your violation of these Terms or applicable law.
10. Changes
We may update these Terms. Material changes will be communicated through the dashboard or by email. Continued use after changes take effect constitutes acceptance.
11. Governing law
These Terms are governed by the laws of the jurisdiction in which Omega Allied Services LTD is registered, without regard to conflicts of law principles. Disputes will be resolved in the competent courts of that jurisdiction unless local consumer law requires otherwise.
